USER DECLARATION
The terms used in this User Declaration shall have the same meanings as the NFT Purchase Agreement and the Terms and Conditions for MYTE Tokens and Mining Services.
I declare that
- I am at least 18 years old or of legal age to form a binding contract;
- I am legally permitted to own virtual assets in my jurisdiction of residence or domicile;
- The use of the Platform, the acquisition of MYTE Tokens and NFTs does not constitute a breach of the laws of my jurisdiction;
- I am not a U.S. Person (as defined in the Purchase Agreement and the Terms and Conditions for MYTE Tokens and Mining Services);
- I am not located in, and I am not a citizen of, domiciled in, or resident of, the United States, Afghanistan, Belarus, Central African Republic, China, Congo, Democratic Republic of the Congo, Republic of the Cote D'Ivoire, Crimea region of Ukraine, Cuba, El Salvador, Eswatini, Gambia, Iran, Iraq, Liberia, Libya, Malawi, Mali, Moldova, Myanmar, Niger, North Korea, Palestinian Territory, Saint Vincent and the Grenadines, South Sudan, Sudan, Syria, Venezuela, Yemen, Zambia, Zimbabwe; any state, country or other jurisdiction that is sanctioned and/or embargoed by the United States of America, the European Union and/or Switzerland; a jurisdiction where it would be illegal according to local law or regulation for my to access or use the Website; or where the provision or availability of the Website is prohibited or contrary to local law or regulation, or could subject Dinola Studio LLC to any local registration, regulatory or licensing requirements;
- I understand the inherent risks associated with holding and/or trading virtual assets and NFTs;
- I understand that the acquisition of NFTs, MYTE Tokens, or use of the Mining Services or the Platform is at my own risk, and that Dinola Studio LLC shall not be liable for any claims or damages whatsoever associated with my use, inability to use, or my interaction with other users of, the Website, the Smart Contracts or the decentralized peer-to-peer protocol, including any direct, indirect, incidental, special, exemplary, punitive or consequential damages, or loss of profits, Virtual Assets, or anything else of value.
- I understand that Dinola Studio LLC does not receive, transfer or hold funds, virtual assets or NFTs on my behalf and does not directly or indirectly facilitate the clearance or settlement of any transactions;
- I have not, and I will not engage in any money laundering, terrorism financing or fraudulent activity; and
- I am exclusively responsible for maintaining the confidentiality and security of my digital or devices I use to acquire NFTs, MYTE Tokens and/or use the Mining Services or the Platform, and that Dinola Studio LLC shall not be liable for any loss or damage arising from my failure to protect my Wallet or devices.
